Section 1
Identification of the Parties
Seller acknowledgment initials
By initialing, each seller acknowledges being informed of the right to a non-exclusive contract and choosing the exclusive one. The broker is required to read that text aloud — the initials are the proof.
Name of agency or broker
Must match the name on the OACIQ licence. "BROKER" in caps = broker on own account; lowercase = broker acting for an agency. The distinction determines which clauses apply throughout the contract.
Real estate agency or broker on own account
Exactly one of the two boxes must be checked. The selection determines which clauses govern the relationship throughout the contract.
Address of establishment
A complete establishment address is part of OACIQ's minimum required identification. Parties must be able to contact each other.
Telephone of agency or broker
Part of OACIQ's minimum required contact set. Required for each agency or broker listed.
Email of agency or broker
Required only if email is the communication method used by the party. Optional per OACIQ guidelines — a missing email is not a defect unless email is the stated channel.
Represented by (broker name)
Identifies the acting broker or team leader. For the "Team" formula, the team name + team-leader licence number must be used.
Licence number
Must match the OACIQ-issued licence. Verifies the acting broker holds a valid licence at time of signing.
Activities within business corporation
Required only if the broker operates within a corporation. If checked, the corporation name must include the broker's common name as it appears on the licence.
Seller name
Full legal name of each seller must appear on the contract. Identifies each contracting party.
Seller address
Address including postal code, per OACIQ minimum required identification. Required for each seller listed.
Seller telephone
Part of OACIQ's minimum required contact set. Required for each seller listed.
Seller email
Required only if email is the communication method used by the party. A missing email is not a defect unless email is the stated channel.
Section 7
Remuneration
Remuneration: percentage or lump sum
Exactly one of percentage or lump sum must be stated. Flagged for review because remuneration is taxable (GST/QST applies) and the rate must be assessed for compliance by a compliance officer.
Shared remuneration with collaborating broker
The percentage or sum offered to a collaborating broker must be present. Flagged for review — unreasonable collaboration terms reduce buyer-agent interest in the property.
